Model Contract
Between Beauty Service Establishment and Educational Institution
THIS AGREEMENT, was made and entered into this ______ day
of ___________, ________
BY AND BETWEEN
The (Name of beauty
service establishment) (hereinafter
referred to as SALON) and (Name
of Cosmetology Educational Institution)
(hereinafter referred to as SCHOOL), the parties, represented
by designees who affix their signatures to this agreement,
agree and consent to the following:
WHEREAS: SALON needs trained, licensed cosmetologists and
specialists in the beauty field to work in its establishment(s);
WHEREAS: SCHOOL is an institution accredited by the National
Accrediting Commission of Cosmetology Arts & Sciences,
Inc. which offers a _______-hour program in subject which
prepares graduates for licensure and entry level work in the
field;
THEREFORE,
1. SALON agrees to identify a person with personality traits
and characteristics which predict success in the cosmetology
field, as well as meeting basic requirements of age and education
set by the state of (name
of state) for licensure in (cosmetology
or the specialization) (hereinafter
referred to as Student) and to send Student to SCHOOL for
training.
2. SCHOOL agrees to provide training to Student in the (name
of program) as approved by the State
and the accrediting agency, to be completed in (number
of months) (Program).
3. In consideration of this service, student has accepted
a loan from SALON, to be paid directly to SCHOOL in the sum
of $_______ which shall constitute payment in full of all
tuition and fees for Student to initiate and complete Program.
4. SCHOOL agrees not to make any additional charges of tuition
or fees to SALON or to Student in exchange for the agreed
training. The amount paid by SALON shall cover all equipment
and supplies as required to complete instruction in Program.
5. SALON has the following responsibilities under this agreement:
- Select Student to undergo training in Program.
- Meet with Student monthly to monitor attendance and academic
progress
- Designate a contact person for all matters related to
this agreement and Student.
- Make payments to SCHOOL according to the following schedule:

6. SCHOOL has the following responsibilities under this
agreement:
- Provide training Program to Student as approved by the
state and accrediting agency, and in accordance with this
agreement.
- Keep accurate reports on attendance. Contact SALON when
Student is absent.
- Give grades to Student for each grading period required
by the school. Contact SALON every time Student receives
less than a satisfactory grade on a graded activity.
- Prepare monthly report of attendance and academic progress
of Student; provide copies to Student and SALON.
- Provide academic counseling to Student.
- Maintain and abide by all requirements for state licensure
and for accreditation.
OPTIONAL CLAUSES:
A. [If the State requires an enrollment agreement between
SCHOOL and Student] If Student and SCHOOL amend Student's
enrollment contract to change the program of study or the
schedule in any way without first obtaining approval from
SALON, the obligations of SALON under this contract shall
be null and void. The sole exception to this provision is
if the hours of the program in which Student is enrolled are
changed to conform to a change in state mandated hours required
by state statute or regulation. In the matter of an exception,
SALON shall be notified within five days of the change.
B. The right is reserved by either party to ask to have
included in Program any additional features which it may deem
necessary for the success of Student. Both parties hereby
agree to give reasonable thought to any such request.
C. SALON shall have at least two opportunities during the
period covered by this agreement to conduct demonstrations
on beauty topics and at times and dates mutually agreed upon
with SCHOOL.
8. SCHOOL agrees to hold harmless the SALON against all
liability, claims, judgments or demands for damages arising
from accidents to Student, persons or property occasioned
by SCHOOL or Student, or its employees or agents or any other
person or persons during the term of this agreement and that
SCHOOL will defend any and all suits.
Injuries or damages, as those words are used in the preceding
paragraph, shall be construed to include, but not be limited
to, injuries or damages consequent upon the failure or use
or misuse by Student, by SCHOOL, its employees or agents of
any equipment, materials, teaching aids, chemicals, techniques,
procedures or treatments.
9. If Student drops out of SCHOOL before completing the
Program, the obligations of all parties under this agreement
shall cease.
10. If SCHOOL loses its accreditation from NACCAS, whether
through withdrawal by the Commission, or voluntary relinquishment,
or if SCHOOL goes out of business, SALON may require SCHOOL
to complete Student's training or provide all documentation
needed for Student to transfer to another institution accredited
by NACCAS.
11. The provisions of this contract must be made a condition
of any sale of SALON or SCHOOL so successors in ownership
shall be bound by them.
12. In the case that SALON declares bankruptcy or goes out
of business before completion of the terms of this contract,
the obligations of the parties under this agreement shall
cease except SCHOOL shall have a lien on the property of SALON
in the amount of all earned payments not yet made.
IN WITNESS WHEREOF, the parties hereto have executed this
agreement the day and year first written above.
